Petition demanding issuance of President’s Rule in Uttar Pradesh: Incompetent and Irrational Government, says C.R. Jaya Sukin

  • The petitioner has moved to Supreme Court seeking an order against Central Government to declare State Emergency in U.P. under Article 365 of the Constitution.
  • The plea is the result of various horrifying incidents that has been taking place in U.P. for past 1 year. Hathras Gang rape, illegal detention of Dr. Kafeel Khan, incompetent and illegal approach against the CAA protestors, human rights violation during AMU violence.
  • The petitioner also alleges that the working of the U.P. government is illegal, irrational, arbitrary, whimsical, and violates the principles of Natural Justice which is the very core of our Indian Constitution.

In matters relating to POSCO Act, only POSCO courts have jurisdiction to hear plea relating to anticipatory bails, says Madras High Court

  • 2 Judge Bench of Madras High Court has ruled that in matters relating to POSCO Act, only the special courts designated under Section 28 of the Act are empowered to entertain anticipatory bail petitions.
  • The Session Court has no power to entertain such petitions.

Interim bail in Habeas Corpus petition to be granted only in certain exceptional circumstances, Madras High Court

  • In the case of Government of Tamil Nadu v. S. Indira Moorthy, Madras High Court has observed that interim bail in habeas Corpus petitions challenging detention can only be granted in certain exceptional scenarios.
  • The Court observed that the power to grant interim bail must be exercised in deserving cases and such powers have intrinsic restrictions and must not be exercised unless and until the circumstances are out of the intervention of the court.

Former JNU student and activist Umar Khalid sent to Judicial Custody for 14 days with adequate security.

  • Former JNU student Umar Khalid has been sent to Judicial Custody for 14 days (till 22nd October).
  • He was arrested under Unlawful Activities (Prevention) Act for allegedly being one of the conspirators in the Northeast Delhi Communal riots.
  • Delhi High Court has ordered the prison authorities to provide Umar Khalid with security to ensure his safety.

Another Petition challenging the constitutional validity of New Farmers’ Act

  • Bhartiya Kisan Party (petitioner) has moved a writ petition challenging the constitutional validity of the 3 farm laws, i.e. – The Farmers’ Produce Trade and Commerce (Promotion and Facilitation) Act, 2020, The Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Services Act, 2020 and The Essential Commodities (Amendment) Act 2020
  • The petitioner claims In his Writ petition that agriculture is a State subject as per Schedule VII List II of the Indian Constitution and the Union is not empowered to make any laws regarding the same.
  • Referring to the case of ITC Ltd. V State of Karnataka, the petitioner has submitted that the 3 above stated acts violate the basic structure of Indian Constitution.
  • Section 18 and 19 of the Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Services Act, 2020 takes away the power of judicial review of the Court.
  • The petitioner has highlighted and stressed on the need to strengthen the existing APMC Act, 2003.

A great step taken by Israel by banning trafficking of animal fur

  • Israel has now banned trading of fur of animals and will approve exception only for research, traditional, education or religious purpose.
  • Earlier these new rules anyone who was interested for trading of animal fur had to apply for a permit firstly.
  • Minister of environmental protection Gila Gamliel issued statement regarding the new law- “The fur industry causes the killing of hundreds of millions of animals around the world and involves indescribable cruelty and suffering. And Utilising the skin and fur of wildlife for the fashion industry is immoral”.
  • Director of People for the Ethical Treatment has applauded this step of Israel.

Maharashtra CM is planning on reopening of religious places

  • Maharashtra CM Uddhav Thackeray, is exchanging views on with different religious institutions and will soon decide on reopening places of worship in the state.
  • Shiv Sena MP Sanjay Raut, while addressing this topic said that while some journalists have been referring and specifying about the opening of restaurants with limited capacity, and the same not happening with temples, where both the matters and places are different and the same thing cannot be done in places of worship.
  • He also mentioned that the reopening of various organizations or institutions will be done mannerly and orderly. Since it is not possible to reopen those in hurry or in ill-mannered way.

It is unlawful to ban the doorstep distribution of newspapers: Delhi

  • United RWAs Joint Action (Urja) announced that delivering newspapers to people at their doorstep, is not only fundamental and needed to the distributors but also to the general public.
  • Banning the distribution of newspapers is totally unlawful and there should not be any impediment or encumbrance in doing so.
  • Atul Goyal, president of Urja, related to this issue, said, “ It has come to our notice there are some housing societies and residents’ welfare associations that are not allowing distribution of newspapers to their residents, which is illegal, wrong, and challenges the integrity of the society. “
  • It also said that in times like these, when people are being able to interact with each other, and are mostly inside the four walls of their house, it is important for them to get updated.
  • When news these days are fabricated, biased and based on falsehood, newspapers are reliable and conclusive, and it also secures the right to information of the people, which is protected by Article 19(1)(a) of the constitution.
  • They also added that the distribution should comply by the instructions given by the government.

Delhi CM to launch Anti-Air movement in the state

  • Arvind Kejriwal, Chief Minister of Delhi, on Monday, launched a great Anti-Air campaign for and because of the worsening air quality in the state, which will be hazardous for being of people there.
  • The campaign named, “Yudh pradushan ke virudh” will specifically and distinctly deal with 13 hotspots in the city.
  • CM uses the term “war room” which will guide and supervise the anti-pollution action and procedures taken by the government of the state.
  • Government while mentioning “Green Delhi” app, said that public can use this as tool to report the issues creating pollution in a certain deadline, and reports will be made accordingly.
  • Kejriwal marked, “Scientists at the Indian Agricultural Research Institute here have found an economical way to deal with the problem. They have prepared a solution which can turn a stubble into a manure.”
  • He said that there are thermal plants near Delhi which add up to the air pollution in the state, and that they should be called upon and asked to reduce their emissions.
  • He will keep updating the citizens regarding this campaign.

According to Scientists, the low-priced, & efficient ‘Feluda’ test could be productive in fighting against Covid-19

  • Named after a scientist character’s name, Feluda, could speed up the testing rates and could help detect corona faster, now when the cases have reached to lakhs.
  • It is a paper based test, which will transform its colour if the patient is tested positive and doesn’t need any extravagant or lavish gadget or machine.
  • It can easily categorize and discriminate easily between SARS-CoV-2 and SARS-CoV.
  • It has CRISPR technology which will detect and avert the virus.
  • While RT-PCR takes hours, competent & skilled labor force, and costly machines, it gives results in about 45 minutes, also can be tested inside laboratories or outside of it.
  • The certainty and sureness of these tests is similar to that of RT-PCR tests.
