The Madhya Pradesh HC quashed the detention order under the NSA, 1980 passed by the District Magistrate

The Madhya Pradesh HC ordered to set the detained person free who was arrested under the National Security Act, 1980.

The MP HC quashed the order passed by the District Magistrate stating that the detention orders passed had not been confirmed within the statutory period of 12 days from the passing of the orders, as given in section 3(4) of the NSA, 1980.

The HC further remarked that the DM had delivered the judgment on the basis of media information and therefore lay down that the judgment was made on the ground of total non-application of mind.

The Supreme Court resumed the hearing of petition against Sudarshan TV’s show “Bindas Bol”

The SC on September 15th, 2020 had ordered to stop the telecast of the remaining episodes of the show, after prima facie observing that the “object, intent and the purpose of the show was to vilify the Muslim community”.

The SC has now resumed its hearing of plea against the show.

A Delhi Court convicted the Srilankan Airlines former Regional Manager of insulting the modesty of his subordinate employee

The Court convicted the accused and found him guilty of outraging the modesty of a woman.

The Court further observed that there is particularly no means through which the “intention” of an accused to insult the modesty of a woman can be determined and that the same can be determined on the basis of the acts of the accused.

The Attorney General rejected the petition to initiate contempt proceedings against Rajdeep Sardesai

The petitioner had initiated a petition demanding contempt proceedings against Consulting Editor of the India Today Group, Rajdeep Sardesai for making derogatory and disrespectful statements via Tweeter on the SC judgments and orders with respect to Prashant Bhushan Contempt Case.

The petition was rejected by the AG KK Venugopal who stated in the order that;

“Mr. Sardesai’s statements are not of so serious a nature as to undermine the majesty of the Supreme Court or lower its stature in the minds of the public. The reputation of the Supreme Court as one of the great pillars of our democracy has been built assiduously over the last 70 years. Trifling remarks and mere passing of criticism though perhaps distasteful are unlikely to tarnish the image of the institution.”

The SC observed that it shall deliver judgment on the plea against conducting NLAT, 2020 on September 21st

The SC decided to deliver its judgment on the plea challenging the conduct of a separate examination (NLAT) by National Law University of India, Bangalore on Monday September 21st, 2020.

The action was brought challenging the sudden withdrawal of NLSIU from conducting CLAT 2020 and holding a separate National Law Admission Test (NLAT), 2020.

The SC laid down to approach the “appropriate High Court” in relation to the plea seeking reasonable time for fees payment

The SC gave liberty to the petitioner to approach “appropriate High Court” with respect to plea seeking the issuance of appropriate directions to the Bar Council of India and the University Grants Commission, to issue a mandate for all the Universities and institutions to provide a treasonable time-period for the payment of fees by the students.

The Calcutta HC asserted the right to a decent burial under Articles 21 and 25 of the Constitution to the COVID-19 victims

The Calcutta HC ruled that the COVID-19 victims have the right to perform decent funeral rites by the family members with restrictions owing to precautions in order to prevent the spread of coronavirus.

The HC further ruled that the above right can be traced within the meaning of Articles 21 and Article 25 which guarantee the fundamental rights, of the Constitution.

The SC observed that “the fact that a lathi is also capable of being used as a weapon of assault, does not make it a weapon of assault simpliciter”

The present case involved the death of the deceased a day after the accused assaulted him with lathi blows on the head.

The Trial Court convicted the accused under section 302 of the Indian Penal Code for murder and the conviction was sustained by the HC though it observed that the assault was not predetermined and had took place in the heat of passion due to a land dispute.

The SC altered the conviction of the accused from section 302 IPC to section 304 Part II, IPC and therefore directed the release of the accused as he had already served the maximum period of punishment prescribed.

Not all plasma may contain protective antibodies

Three kind of antibodies are produced in an infection i.e. IgG, IgA, IgB where the neutralizing effect was most visible in case of IgGs
