Karnataka HC rejects the PIL against the bar

Public Interest Litigation filed by Advocate AV Amarnathan stated that the statue of Father of Nation, Bal Bhavan in cubbon park, office of Deputy Commissioner of Police and a church are situated with in a distance of 100 metre from the premises of the bar. He is seeking to cancel the licence granted by a state excise department to Tonique Bar and Restaurant for the allegation of its proximity to a Gandhi statue. He also contended the breach of sub-rule (3) of rule 3 of the Karnataka Excise Licence ( General Conditions) Rules , 1967 defines the definition of ‘Religious Institution’ and the statue of Father of Nation is a ‘Religious Institution’.

On Monday , the petitioner also claimed for sub-rule [2-A] of rule5 of the Karnataka Excise Licence Rules.

However, Additional Government Advocate Vijayakumar A Patil file a memo of compliance which recorded the distance between the main entrance of the premises of restaurant and the office of the Deputy Commissioner of Police through the footpath is 126.50 meters. secondly, the distance between the main entrance of the fifth respondent and the entrance gate of St. Martha’s Church is 144.00 meters.

A division bench of Chief Justice Abhay Oka and Justice NS Sanjay Gowda rejects the PIL because they don’t find merit in any stated arguments.

SC adjourned the hearing of moratorium payment on 28 September

The moratorium period for loan and EMI payments was over by August, but the grace period is dragging on the final decision to settle the decision of banks to charge an additional interest rate.

SC gives time to SG Mehta for concrete reply on the behalf of Center and RBI . So, the  matter will to be adjourned again.

Gujarat HC suspended physical and virtual hearing from September 12th-15th 2020

Gujarat HC stopped the physical and virtual hearing due to 12 employees were found to be infected with covid-19. Therefore, physical functioning will be suspended from September 12-15 for sanitization purposes. Further physical functioning of limited courts will commence from 14th September 2020 will now commence from 16th September 2020.

The Apex Court  held that ,In order to challenge an order which has been passed by the High Court in the exercise of its Judicial powers would not beb maintainable under the Writ petition of Article 226 of the Constitution. In the Case of Pravin Kumar Vs. Union of India [ Civil Appeal No. 6270 of 2012]

The Apex Court dismissed the appeal of a CISF officer who was dismissed from the service for indulging in corruption and said that punishment of dismissal is not disproportionate to corrupt employees and charges like corruption, misappropriation etc are grave and ought to be dealt with strictly. The bench comprises of Justice NV Ramana , S. Abdul Nazeer and Surya Kant.

Rizwan Khan Vs State of Chhattisgarh [ Criminal Appeal No.580 of 2020]

The Appex court in the bench of Justice Ashok Bhushan , MR Shah and R.Subhash Reddy observed that to prove the case under NDPS Act , the ownership of the vehicle from which the contaband is seized is not required to be established , the thing which is required to established and proved is the recovery of the contraband articles and the commission of an offence under the NDPS Act . Further the court also said that examination of independent witnesses is not the indispensable requirement and non examination is not necessarily fatal to the prosecution case.

Nirav Modi’s Extradition: Katju to Depose in UK court

Former SC judge Justice Markandey Katju will testify as a witness on September 11 in UK court against the extradition of Nirav Modi to India.

Katju further said, he will oppose the extradition on the grounds that Nirav is unlikely to get “free and fair trial in India”.

Owing to security risks, U.S. President Trump orders suspension of visas of more than 1,000 Chinese nationals :

Leading to deteriorating relations between China and the U.S., the world’s two biggest economies; the U.S. President Donald Trump ordered revocation of visas of more than 1,000 Chinese nationals.

The action was seen as a response to China’s curbs on democracy in Hong Kong, and also to prevent the security risks. The visa action was being undertaken under a proclamation by President Trump on May 29, 2020.

As mentioned by the acting head of the U.S. Department of Homeland Security, Chad Wolf backed the order of Trump by stating it (i.e., the order) as the strategy in order to protect U.S. based sensitive research including coronavirus research from being stolen by China. Mr. Wolf further accused China of abusing and misusing student visa to exploit American academia.

Wildfires now head towards Oregon, the neighbouring state of California, after plaguing and wreaking havoc in California

The unprecedented fierce and unstoppable wildfires led to the destruction of five small towns in Oregon resulting in high death toll and increased number of casualties.

As three fatalities were confirmed in northern California, the wildfires continued to create havoc in California and Oregon. The wildfires have led to the destruction of much of the western U.S. over the past week through its major roaring blazes with greater intensity.

Governor Kate Brown described the fierce wildfires as “This could be the greatest loss in human lives and property due to wildfire in our state’s history.” Brown further gave details of the rescue teams saving the evacuees and moving them to a safer destination.

A long awaited action finally reaches its implementation as U.S. military makes a formal announcement of reduction in its troops in Iraq

The U.S. has around 5,200 troops stationed and deployed in Iraq in order to counter the Islamic State militant group.

The action comes as a result of June, 2020 affirmation between the U.S. and Iraq, both making commitment regarding the reduction of U.S. troops in Iraq in coming months.

Iraq’s Parliament had already voted earlier this year for the departure of foreign troops from Iraq. In addition, during a meeting held last month with the Iraqi Prime Minister, the U.S. President Trump, already assured his firmness over reduction of U.S. troops in Iraq.

A formal announcement for the same was made by the U.S. President Donald Trump stating reduction of U.S. military troops in Iraq from 5,200 to 3,000 troops.

Amid increasing tense relations between China and the U.S., the U.S. government sells off its consulate staff compound to Hong Kong for $332 million

The U.S. has sold its consulate staff compound to Hong Kong’s local developer Hang Lung Properties Ltd. for HK $2.57 billion which is equivalent to $332 million.

The move comes at a sensitive time taking into consideration the escalating tensions between China and the U.S.

Backing this sale, a representative of the U.S. government mentioned that the decision to sell the compound was an action in furtherance of its global reinvestment program development.

The WWF’s Living Planet Report 2020 claims a reduction of 68 per cent in the global wildlife population between 1970 and 2016

  • Owing to unpredictable climate changes and increased pollution, a greater harm and damage has been caused to the biodiversity. One of the most prominent factors leading to biodiversity loss is land-use change.
  • Europe and Central Asia with 57.9 per cent, have topped the list of highest biodiversity loss due to land-use change globally, whereas according to the Living Planet Index, Latin America with 94 per cent has suffered largest wildlife population loss.
  • The Report further mentions that freshwater biodiversity has been one of the most threatened biodiversity globally accounting for the loss of almost 90 per cent of global wetlands since 1700.
  • The WWF India’s report on Water Stewardship for Industries further revealed that 14 out of 20 river basins in India are already water stressed.

Covid-19  vaccine   could  be available  by end 2020  said by AstraZeneca

Drugs giant AstraZeneca said that Covid-19 vaccine could be available by end of 2020 or early 2021 despite of trial paused after an illness in a participant in Britain. AstraZeneca might resume clinical trials of its Covid-19 vaccine next week.

China has named Nong Rong as the country’s  nee Ambassador  to Pakistan

On Thursday China named Nong Rong as a country’s new Ambassador to Pakistan and Yao Jing has been transferred back to headquarters in Beijing.  Compared to Yao, Nong has not served in Pakistan before being nominated to the post.
